This document (together with all texts mentioned herein) establishes the conditions governing the use of this website (www.cocunat.com) as well as any others of the business group (jointly and interchangeably, the "website") and the purchase of products on it (hereinafter, the "Conditions"), regardless of the application, digital medium, support or device through which it may be accessed. Please read these Conditions carefully before using this website. By using this website or placing an order through it, you accept the Terms of Use and Purchase of COCUNAT, so if you do not agree with these Conditions you should not use this website.

If you have any questions related to these Conditions or any other legal text published on our website, you may contact Us through our contact channels.

The contract may be formalized, at your choice, in any of the languages in which the Conditions are available on this website.

2. OUR DETAILS

These terms and conditions apply to all sales made through the website of Cocunat S.L. or any of the companies in our business group (hereinafter, "COCUNAT" or "We"). These terms apply to any sale regardless of where in the world the consumer is located. In any case, it may be supplemented by the national legislation of the country in question.

The personal information or data you provide us will be processed in accordance with COCUNAT's Privacy Policy. For more information, we invite you to carefully read our Privacy Policy.

4. USE OF OUR WEBSITE

4.1. By using this website and placing orders through it, you agree to:

5. SERVICE AVAILABILITY

5.2. If you wish to place an order from another country through this website, of course you may do so; however, please note that we only offer deliveries to a shipping address in the same territory as the website, excluding in any case the Canary Islands, Ceuta and Melilla.

6. HOW TO PLACE AN ORDER

6.1. To place an order on the COCUNAT website, you must follow the online purchase procedure and click on the "pay" button. After completing the purchase process, you will receive an email acknowledging receipt of your order (the "Order Confirmation"). We will also inform you by email that the product is being shipped (the "Shipping Confirmation"). If you do not receive this email, check your spam folder. If you still cannot find it, you can contact us at [email protected].

If you are a registered user, you have a detail of all orders placed in the "My Account" section.

7. GUEST PURCHASE

This website also allows purchases through the guest purchase functionality.

In the guest user purchase mode, COCUNAT will only request the necessary data to process your order.

8. RIGHT OF WITHDRAWAL AND RETURN POLICY

8.1. Right and period to withdraw. If you are contracting as a consumer, you have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which you or a third party designated by you, other than the carrier, acquired physical possession of the goods, or in case the goods that make up your order are delivered separately, 14 calendar days from the day on which you or a third party designated by you, other than the carrier, acquired physical possession of the last of those goods.

8.2. How to exercise this right. You may exercise the right of withdrawal in the easiest way for you through an unequivocal statement (for example, using the form attached in the Annex to these Conditions or by sending an email) notifying us of your decision to withdraw from the purchase at the address, Carrer de Folgueroles 17, 08022, Barcelona, Spain, or through our email [email protected].

To meet the withdrawal deadline, it is sufficient that the communication regarding the exercise of your right is sent before the deadline indicated in point 8.1, paragraph 2 expires. COCUNAT will communicate to you without delay the receipt of your withdrawal communication.

8.3. Consequences of withdrawal. In case of withdrawal, we will refund all payments made by you, including shipping costs, but excluding additional costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer, without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will make said refund using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise and provided that it does not imply any cost as a result of the refund. However, we may withhold the refund until we have received the goods.

8.4. Return process. You must return or deliver directly or through a courier the products you want to return to the following address: COCUNAT S.L., C/ Newton 22, 08635, Sant Esteve de Sesrovires, Barcelona.

8.5. Care and attention. We ask that you be careful with the products while they are in your possession; it is important that you return the item including the original COCUNAT packaging, instructions and other documents that may accompany them. The use of the purchased products, beyond mere opening and provided they are not sealed products, may result in the application of the provisions of point 8.7 and, depending on the case, the impossibility for COCUNAT to accept the cancellation of the purchase. Therefore, for the return of goods, it is important that you follow the instructions that will be indicated in the return acceptance email.

8.6. Costs. You must bear the direct cost of returning the goods for which you have exercised the right of withdrawal.

8.7. Diminished value. You will be responsible for the diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

8.8. Refund. We inform you that COCUNAT may withhold the refund until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.

Your right of withdrawal may be affected if it has been exercised outside the stipulated period, if one or more products of the order with respect to which the right has been exercised respectively have not been returned, among other cases that may occur.

Therefore, COCUNAT will inform you if you are entitled to a refund of the amounts paid in the corresponding cases and after the appropriate verifications in accordance with the provisions of the Consolidated Law for the Defense of Consumers and Users.

8.9. Exceptions to the right of withdrawal. You will not have the right to withdraw from the contract whose object is the supply of any of the following products:

If you have made a purchase before 31.01.2026 and wish to exchange or return a product that was delivered to this territory, you may do so by contacting us by email at [email protected] to provide you with the corresponding information regarding the return or exchange.

If you have placed an order through this website from an EU Member State other than Spain, the conditions for exercising the right of withdrawal will be of the same application. We also inform you that we will not be obligated to reimburse shipping costs other than those incurred up to the original delivery address in Spain or return costs from a destination outside Spanish territory.

9. TECHNICAL MEANS FOR ERROR CORRECTION

9.1. In case you detect that an error has occurred when entering your personal data during your registration as a user of this website, you may modify them in the "My Account" section.

In any case, you may correct errors related to personal data provided during the purchase process by contacting our customer service through our email [email protected].

9.2. This website displays confirmation windows in various sections of the purchase process that do not allow proceeding with the order if the data in these sections has not been provided correctly. Likewise, this website offers the details of all items you have added to your cart during the purchase process, so that before making the payment, you may modify the data of your order.

If you detect an error in your order after completing the payment process, you must contact our customer service immediately at the email address mentioned above to correct the error.

10. PRODUCT AVAILABILITY

10.1. All orders are subject to product availability. COCUNAT will make all possible efforts to supply the products purchased according to your order summary; however, there may be occasions when COCUNAT cannot supply such products. This may be because, for example, those products were not in stock or an error was identified in the price or product description, etc. In these cases, COCUNAT will contact you to inform you and, if applicable, propose alternative products that fit your needs. If you are not interested in these product alternatives, COCUNAT will proceed to cancel your order in relation to the products that cannot be supplied, and you will receive a refund of the amount paid for this item.

In these cases, COCUNAT will only be responsible for refunding the amount paid by you, without you having the right to claim additional amounts.

10.2. It may also happen that COCUNAT cannot accept your order. In this case, you will be contacted as soon as possible through any of the means you provided at the time of placing the order to propose alternatives.

11. DELIVERY

11.1. Before finalizing the order, you must select the delivery method that best suits your needs. We will send you your order consisting of the products listed in each Shipping Confirmation without undue delay and no later than within 72 hours from the date of the Order Confirmation, except as provided below.

Please note that there are circumstances arising from product customization, or unforeseen or extraordinary circumstances that may affect the delivery date.

11.2. If for any reason we cannot meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note, in any case, that we do not make home deliveries on Saturdays or Sundays.

For the purposes of these Conditions, "delivery" or the order shall be deemed "delivered" at the moment when you or a third party indicated by you acquires physical possession of the products, which will be evidenced by signing for receipt of the order at the delivery address you have provided.

12. IMPOSSIBILITY OF DELIVERY

12.1. You agree that you or another designated person will be at the indicated address to receive the COCUNAT order. If not present, the carrier will attempt a new delivery or, if possible, will contact you.

12.2. In the event that delivery was not possible, your order will be returned to our warehouse with the consequent refund of the payment made minus the shipping or return costs, which may arise, which will be at your expense.

In case 15 days have passed since your order is available for delivery and the order has not been delivered for reasons not attributable to COCUNAT but due to your disinterest or failure to collect it, we will understand that you wish to withdraw from the contract and will consider it terminated. As a result of the contract termination, we will refund all payments made by you, excluding delivery costs, as well as additional costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer, without undue delay and, in any case, within 14 calendar days from the date on which we consider the contract terminated.

13. PRE-ORDER OF ITEMS

13.1. In the case of purchasing pre-order items, these will be delivered to the address you selected within the deadlines indicated on our website.

Please note that some of these items are subject to longer delivery times, which will be those shown on the website and, in any case, will be delivered within a maximum of 30 days from the date of the Order Confirmation.

13.2. In the case of mixed orders consisting of products from the ordinary purchase process and pre-order products ("Mixed Orders"), the items will have been ordered by you in the same order but may be delivered separately and at different times according to the availability at any given time of the pre-order products and in accordance with the provisions of these Conditions.

Once the pre-order products have been prepared, we will contact you to inform you that they are being shipped ("Shipping Confirmation").

If you make a purchase of a pre-order product, all the provisions contained in these Conditions will be equally applicable, without prejudice to the provisions of this clause.

14. SUBSCRIPTION SYSTEM APPLICABLE TO THE CLUB COCUNAT SUBSCRIPTION

14.1. The CLUB COCUNAT consists of the delivery of predetermined COCUNAT products specified in the product sheet at https://cocunat.com/en-gb/club/

With three modalities: CLUB BASIC, CLUB PLUS and CLUB ÉLITE. To enjoy any of these modalities, in addition to registering on the COCUNAT website, you must acquire the CLUB subscription which has a duration of 6 months and entails 1 product delivery every 28 days. The subscription is unique per user; it is not possible to subscribe more than once.

To acquire the subscription, you must access from the CLUB section of the website and choose the desired modality, as well as the product(s) to start the subscription. Once the shipping form is processed and filled out, you will receive confirmation of your enrollment at the indicated email.

14.2. The shipping date for products included in CLUB BASIC, CLUB PLUS and CLUB ÉLITE is generated automatically, every 28 days. Likewise, on the same date of the monthly product shipment, the subscription fee will be charged. However, COCUNAT informs you that the shipping date is an estimate and warns you that there may be delays in the shipment of CLUB product orders, so you will not be entitled to any refund for any delays or unforeseen events that are beyond COCUNAT's control.

In case of address change, it is your responsibility to update the shipping data for orders. You will be informed that, prior to the shipment of the next product order, you will receive an email through which you may add other COCUNAT products to your cart, if you wish, or modify the chosen product.

14.3. The subscription price for CLUB COCUNAT (39€), CLUB COCUNAT PLUS (59€), CLUB COCUNAT ÉLITE (79€) includes shipping costs.

14.4. To cancel the subscription, you must access your personal space in Club and select the Cancel Subscription option. You may also contact our customer service team: [email protected]

Subscription cancellation can be done at any time, but respecting the commitment period indicated in this clause. However, you are informed that CLUB is a one-time subscription and that, in case of cancellation, you will not be able to resume it to continue enjoying all its benefits.

14.5. The commitment period will last 6 months, and entails 1 product delivery every 28 days. After the 6-month commitment period, it will be automatically renewed for another 6 months and so on consecutively, unless cancellation is requested prior to the renewal date as indicated in the previous point.

15. TRANSFER OF RISK AND OWNERSHIP

15.1. The risks of the products will be at your expense from the moment of delivery.

You will acquire ownership of the products when we receive full payment of all amounts due in relation to them, including shipping costs (in case the minimum order is not reached), or at the time of delivery (as defined in clause 11), if this occurs at a later time.

16. PRICE AND PAYMENT

16.1. The prices on the website include VAT but exclude shipping costs, which will be added to the total amount.

Product prices may be subject to changes, but possible changes will not affect orders for which we have already sent you an Order Confirmation.

16.2. Once you have selected all the items you wish to purchase, they will have been added to your cart and the next step will be to process the order and make the payment. To do so, you must follow the steps of the purchase process, filling in or checking the information requested at each step.

Likewise, during the purchase process, before making the payment, you may modify the data of your order.

16.3. You may use as payment methods Visa, Mastercard, American Express, Affinity Card, PayPal, Shop Pay. If you opt for payment by credit/debit card, the order will be processed once the payment has been authorized by your bank.

By clicking on the "Pay" button you are confirming that the credit card is yours or that you are authorized to use it. However, if the security department suspects any anomaly or fraud, COCUNAT reserves the right to cancel the transaction for security reasons.

Online payment by credit/debit card is made through the "Secure Socket Layer" security system, which encrypts your banking data when transmitted over the internet. Credit cards will be subject to checks and authorizations by the issuing entity, but if said entity does not authorize the payment, we will not be responsible for any delay or non-delivery and we will not be able to formalize any contract with you.

For security policy reasons, COCUNAT verifies all orders paid by bank card.

In general, COCUNAT also accepts cards that use the Verified by Visa secure payment system or the 3-D Secure system.

17. PROMOTIONS AND COUPONS

17.1. All promotions and coupons have a specific expiration date, as indicated in the promotion itself.

Promotions consisting of discount coupons will always be applied solely and exclusively to the product value.

COCUNAT reserves the right to cancel its promotions for users who make improper use of them, or who under different identities acquire numerous units of the promotion.

18. VALUE ADDED TAX AND INVOICING

In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax, and other applicable provisions, the delivery of items will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory. The applicable VAT rate will be the legally effective rate at any given time depending on the specific item in question.

You expressly authorize us to issue the invoice in electronic format and send it to you by email to the address provided to COCUNAT, although you may indicate to us at any time your wish to receive a paper invoice, in which case we will issue and send the invoice in that format. You may request this by contacting our customer service, through any of the means made available to you and free of charge.

19. WARRANTIES

19.1. If you contract as a consumer and user, we offer you complete health, technical and storage warranties on the products we market through this website, under the terms legally established for each type of product, taking into account that our products do not exceed 6 months in our warehouses.

We inform you that, as a consumer, you have a period of 2 months to inform us of the lack of conformity, counted from when you became aware of it.

In any case, the lack of conformity must have manifested within a maximum period of two years from delivery of the product, in accordance with the provisions of clause 21.

19.2. Products are understood to be in conformity with the contract provided that:

  1. They conform to the description made by us and possess the qualities that we have presented on this website;
  2. They are fit for the purposes for which products of the same type are ordinarily used;
  3. They present the usual quality and performance of a product of the same type that are reasonably expected;
  4. The product has remained closed since we are talking about a perishable good that is governed by PAO ("Period After Opening") according to the product formulation, but this may be less than 2 years;
  5. If the product has been opened, the non-conformity is within the PAO ("Period After Opening") dates indicated on the packaging;
  6. The storage conditions are within those recommended by the AEMPS (Spanish Agency for Medicines and Health Products) for the care of a cosmetic product;
  7. The product has been used correctly and reasonably.

19.3. In this sense, if any of the products is not in conformity with the contract, you must inform us by following the procedure detailed in clause 8 and through any of the communication channels provided for this purpose or by email at [email protected].

19.4. The products we sell may often present the characteristics of the natural raw materials used in their manufacture. These characteristics, such as variations in color, texture, or smell, will not be considered defects or flaws. On the contrary, their presence should be expected and appreciated as they are a sign of the naturalness of the product. We only select the highest quality raw materials, but natural characteristics are inevitable and must be accepted as part of the individual appearance of the product.

20. DEFECTIVE OR NON-CONFORMING PRODUCTS

20.1. In cases where you consider that the product delivered to you does not conform to the characteristics and qualities indicated on our website, has some type of manufacturing problem, may be in poor condition due to transport problems or otherwise, or is related to cosmetovigilance matters (and therefore used or opened), we ask that you contact us immediately through our contact channels providing the details of your order, as well as indicating the defects that, according to you, the delivered product suffers from, so that we can indicate how to proceed.

In the event of a product non-conformity and in general, the consumer has the right to repair of the product (where possible), to its replacement, to a price reduction (where applicable) or to contract termination which involves the return of the product on your part and the corresponding refund of the amount paid, but we warn you that these options are not always possible, depending on the type of product and company policy respectively.

Due to the type of products marketed by COCUNAT, the options available to you are the replacement of the item or directly the refund of the price paid by you and return of the defective item if the first option is not possible.

20.2. You are informed that, if the lack of conformity is minor, contract termination will not apply.

20.3. In these cases, COCUNAT will proceed to carefully examine the returned product and will communicate by email within a reasonable period whether free replacement or a refund of the price paid for the product is applicable, if replacement is not possible.

The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days following the date of the email confirming that the replacement of the non-conforming item or the refund of the price paid for it is applicable.

20.4. The amounts paid for products that are returned due to some flaw or defect, when it actually exists, will be fully refunded to you, including the delivery costs incurred to deliver the item to you and the costs you may have incurred to return it to us. The refund of the price paid will be made through the same payment method used to pay for the purchase.

20.5. As a general rule, you may return the defective product free of charge by handing it to the courier that COCUNAT will send to the provided address, after having requested the product pickup.

21. LIABILITY AND DISCLAIMER

Unless expressly stated otherwise in these Conditions, our liability in relation to any product purchased on our website will be strictly limited to the purchase price of said product.

22. INDUSTRIAL AND INTELLECTUAL PROPERTY

22.1. The domain name, as well as all the content of the COCUNAT website, Blog and Social Media (including but not limited to web design, photographs, illustrations, texts, names, brands, images, videos, etc.) is the property of COCUNAT.

COCUNAT is the only one authorized to use, whether by original title or by express authorization, the corresponding intellectual property rights, so any partial or total reproduction of the content by any procedure and on any medium is subject to prior and express authorization from COCUNAT.

22.2. The user is strictly prohibited from using the Website or part of it for purposes other than personal, private and commercial use, in particular, through downloading, reproduction, transmission, representation or dissemination of its content.

22.3. The creation of hypertext links to any of the web pages or elements that compose them is prohibited without prior written authorization from COCUNAT, which may be revoked at any time.

This will not prevent you from using this website to the extent necessary to copy information about your order or Contact details.

23. VIRUSES, HACKING AND OTHER COMPUTER ATTACKS

23.1. You must not make improper use of this website by intentionally introducing viruses, trojans, worms, logic bombs or any other technologically harmful or damaging program or material. You will not try to have unauthorized access to this website, the server on which this page is hosted or any server, computer or database related to our website. You agree not to attack this website through a denial of service attack or a distributed denial of service attack.

23.2. Non-compliance with this clause could lead to the commission of offenses classified by applicable regulations. We will report any breach of said regulations to the competent authorities and will cooperate with them to discover the identity of the attacker. COCUNAT is not responsible for any damage or loss resulting from a denial of service attack, virus or any other technologically harmful or damaging program or material that may affect your computer, computer equipment, data or materials as a result of the use of this website or the downloading of content from it or those to which it redirects.

24. LINKS FROM OUR WEBSITE

In the event that our website contains links to other websites and third-party materials, such links are provided for informational purposes only, and we have no control over the content of such websites or materials. Therefore, COCUNAT is not responsible for any damage or loss arising from their use.

25. WRITTEN COMMUNICATIONS AND COMMUNICATION CHANNELS WITH COCUNAT

25.1. We will contact you by email or provide you with information by posting notices on this website. For contractual purposes, you consent to use this electronic means of communication and accept said means of communication between you and COCUNAT.

Notifications that you send us must be sent through our email [email protected] or via the questionnaire that can be found on our website.

25.2. In accordance with the provisions of the first paragraph and unless otherwise stipulated, we may send you communications either by email or to the postal address provided by you when placing an order.

26. EVENTS OUTSIDE OUR CONTROL

26.1. We will not be liable for any failure or delay in the fulfillment of any of the obligations assumed, when the same is due to events that are outside our reasonable control ("Force Majeure").

Force Majeure causes will include any act, event, failure to exercise, omission or accident that is beyond our reasonable control and among others, the following:

  1. Strikes, lockouts or other industrial action.
  2. Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.
  3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
  4. Impossibility of using trains, ships, aircraft, motor transport or other means of transport, public or private.
  5. Impossibility of using public or private telecommunications systems.
  6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.
  7. Global pandemic similar to SARS COVID-19.

It will be understood that obligations will be suspended during the period in which the Force Majeure continues, and we will have an extension of the deadline to fulfill said obligations for a period of time equal to the duration of the Force Majeure. We will put all reasonable means to end the Force Majeure or to find a solution that allows us to fulfill our obligations despite the Force Majeure.

26.2. Exceptionally and due to the global health crisis triggered by Covid-19, return periods may be interrupted by incidents, mobility restrictions, etc., arising from the declaration of the State of Alarm by the Spanish Government or the government of the country where the product is to be delivered, until the Law provides for it.

27. WAIVER

The failure on our part to require strict compliance on your part with any of the obligations assumed by you under a contract or these Conditions, or the failure on our part to exercise the rights or actions that we could have under said contract or the Conditions, will not constitute a waiver or limitation in relation to said rights or actions nor will it release you from compliance with such obligations.

No waiver on our part of a specific right or action will constitute a waiver of other rights or actions arising from a contract or the Conditions.

No waiver on our part of any of these Conditions or of the rights or actions arising from a contract will be effective unless it is expressly stated to be a waiver and is formalized and communicated to you in writing in accordance with the provisions of the Notifications section above.

28. PARTIAL NULLITY

If any of these Conditions or any provision of a contract is declared null and void by a final resolution issued by a competent authority, the remaining terms and conditions will remain in force, without being affected by said declaration of nullity.

29. COMPLETE AGREEMENT

These Conditions and all documents expressly referenced herein constitute the entire agreement between you and us in relation to the subject matter hereof and supersede any other pact, agreement or promise previously agreed upon between you and us verbally or in writing.

30. OUR RIGHT TO MODIFY THESE CONDITIONS

We reserve the right to modify the Terms and Conditions. The modifications introduced will not be retroactive.

If you do not agree with the modifications introduced, we recommend that you do not use our website.

31. APPLICABLE LAW AND JURISDICTION

31.1. These Conditions will be governed by Spanish law, without prejudice to legal regulations for the protection of consumers and users that may be applicable.

31.2. In the case of disputes arising from the use of our website and the purchase of our products, and without prejudice to the mandatory rules of submission established by legal regulations for the protection of consumers and users that may be applicable, the parties expressly waive any other forum or jurisdiction to which they may be entitled, and agree to submit to the courts of the city of Barcelona.
